This Privacy Policy describes how PumpkinKart , its subsidiaries and affiliates (collectively “PumpkinKart”, “we”, “us”, “our”) collect, use and share your information when you use our website located at www.PumpkinKart.ca (the “Site”), our mobile applications (collectively the “App”) and other services we may offer (the Site, App and other services are collectively referred to as the “Platform”).  This Privacy Policy also explains how we use cookies and similar technologies.  By using the Platform, you agree to be bound by the terms and conditions of this Privacy Policy.
We may change our Privacy Policy from time to time. If we make changes to our Privacy Policy, we will notify you by posting the updated Privacy Policy and revising the “Last Updated” date above.   We encourage you to review this Privacy Policy frequently to stay informed about our privacy practices.  By continuing to use the Platform after the changes are made, you agree to be bound by the revised Privacy Policy. 

What information do we collect?

Personal Information you provide to us

Personal information is information about an identifiable individual.  We collect personal information when you voluntarily provide it to us through our Platform or through other means.  For example, we may collect personal information such as your name, address, email address and telephone number when you create an account, make a purchase, enter a contest or promotion, communicate with us, submit a review, register to receive a newsletter, take a survey or otherwise submit personal information to us with your communication.
When you make a payment through the Platform, we and/or our third-party service provider also collect billing-related information such your name, address, email address and credit card details.  You may voluntarily store your billing-related information with us and/or our third-party service provider. Collection through Cookies and other Technological Means

We may use “cookies” and other technologies for authentication, analytics, performance, functional and marketing purposes. We may also use third-party service providers, such as Google Analytics, which use cookies or other technologies to record information about you or your activity. A “cookie” is a piece of data stored on the computer hard drive or memory containing information about the user. You may modify your browser’s settings so that your browser stops accepting cookies or prompts you before accepting a cookie. If you do not accept cookies, you may still use the Platform, but certain areas or features may not function properly.
We may collect personal information when you use with the Platform.  For example, when you make a purchase through the Platform, we collect information about the transaction, including information related to the product, order and payment.
We may also collect your precise or approximate location information from your mobile device if you have enabled this feature.  We collect this information when the App is running in the foreground (the App is open and, on your screen,) or background (App is open, but not on your screen) of the mobile device.
The information we collect using cookies and other technologies may also include your IP address, browser type, device and system information, unique device identifier, device motion data, mobile network data, the web page you visited before accessing the Platform, advertising identifiers, date and time stamps, crash reports, system activity and other similar information and interactions with the Platform.

Interest-Based Advertising / Remarketing

We or our third-party advertising providers may use cookies and small pixel files (small images) to keep track of your browser so that you will be recognized when you visit other websites where our third-party advertising providers may show you advertisements from us based on your visit to our Platform. Some of these advertisements may be customized to particular products that you viewed, or they may be based on inferences about products and services that you might be interested in. This is called "interest-based advertising".
You can opt out of these interest-based advertising campaigns by turning off cookies in your browser, as described above. If you opt-out of interest-based advertising, you may still see advertisements from us on other websites. However, they will not be customized based on your browsing history on our Platform.

How do we use your information?

We use your personal information to provide products and services and to manage our business operations.  For example, we may use your personal information for the following purposes: We retain your information for as long as necessary to fulfill the purposes for which we collected the information or as required by law.

How do we share your information?

We may share your information with our affiliates and third-party service providers who help us with our business operations. For example, we share information with service providers or our affiliates who provide us with development, storage, marketing, analytics, payment processing and promotional services.
We may share your information with restaurants and other merchants for purposes including the fulfillment of orders which you placed and to provide them with analytics and other usage information.
If we are involved in a merger, acquisition, or sale of all or a portion of our assets, we may transfer your personal information as part of that transaction.
If you choose to submit a review of a restaurant or other merchant on the Platform, your review may be published on the Platform and shared with the applicable restaurant or merchant. You also consent to us using such reviews in any marketing or advertising materials.
We may share information about you if necessary, for us to collect a debt from you or as permitted or required by law, for example with regulators and law enforcement agencies.
We may also share aggregated demographic or otherwise non-personal information with our partners and advertisers, such as usage statistics of the Platform.

How do you change your information?

If you have an account, you may review and change personal information which you provided to us by logging into your account and modifying the personal information stored in connection with your account. If you do not have an account or for other questions about our privacy practices, you may contact us using the email address below. 

Links to Third-Party Sites and Social Networks

The Platform may contain links to third-party websites, including social networks. These links are provided for your convenience.  We have no control over and are not responsible for the privacy practices of such other websites. We encourage you to be aware when you leave our Platform and to read the privacy statements of each and every website that collects personal information. This Privacy Policy applies solely to information collected by this Platform.

Storage Outside of Canada

Your personal information may be stored by us or our service providers outside of Canada.  If your personal information is used or stored outside of Canada, it will also be subject to the laws of the country in which it is used or stored.

Security

We follow generally accepted standards to protect your personal information. For example, our Platform is encrypted and protected SSL encryption software.  However, no method of electronic transmission or platform is 100% secure.  Therefore, we cannot guarantee that unauthorized access, hacking, data loss or breaches of our security systems will never occur. Accordingly, you should not transmit personal information to us using our Platform if you consider that information to be sensitive.

Additional Protections for Minors

The Platform is intended for individuals who are of the age of majority in the jurisdiction of residence. We do not knowingly collect solicit or collect personal information from individuals under the age of 13.  If you become aware that a person under the age of 13 has provided us with personal information, please contact us at the email address below and we will take steps to delete such information.

How do I permanently delete my account?

We ask individual Users to identify themselves and the information requested to be accessed, corrected, or removed before processing such requests, and, to the extent permitted by applicable law, we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others or would be extremely impractical (for instance, requests concerning information residing on backup tapes). After your account has been deleted, you won't be able to retrieve anything you've added. To permanently delete your account, you may contact our Privacy Officer at support@pumpkinkart.com. We will delete all of your information within 72 hours.
